FBFK Law shareholder Solomon L. Wisenberg was featured in an NPR Morning Edition report, “Former FBI Director James Comey to Appear in Court,” providing legal analysis of the Justice Department’s latest attempt to prosecute former FBI Director James Comey.

Speaking with NPR correspondent Carrie Johnson, Wisenberg, a former federal prosecutor, addressed the legal challenges surrounding the case, particularly questions involving the statute of limitations.

Federal prosecutors allege that Comey authorized the disclosure of national defense information to The New York Times in October 2016. Comey denies the allegations. According to CBS News, prosecutors filed a criminal information rather than obtaining a grand jury indictment, prompting a legal dispute over whether the filing satisfied the applicable statute of limitations. The distinction between these charging documents is addressed under Rule 7 of the Federal Rules of Criminal Procedure.

Wisenberg expressed skepticism that the case would proceed to trial, citing concerns about whether prosecutors acted within the legally required timeframe.

“I will be absolutely astounded if it’s not dismissed before trial,” Wisenberg told NPR.

The legal dispute continued during an October 30 court hearing, when a federal judge postponed a decision on whether to dismiss the filing while prosecutors pursued a grand jury indictment.

With four decades of experience in federal criminal law and white-collar defense, Wisenberg brings extensive knowledge of complex federal investigations and prosecutions. His background includes serving as an Assistant United States Attorney and Deputy Independent Counsel in the Whitewater-Lewinsky Investigation.
