Permian Basin Wastewater Litigation

Representing Stateline Operating LLC, Michael is pursuing a $180 million claim against Devon Energy and Aris Water Solutions, alleging that excessive wastewater injection compromised Stateline’s oil-producing reserves in the Permian Basin.
At the center of the dispute is a timely legal question: when does risk evolve into harm, and when does harm become legally actionable? As Michael stated to the court, “It only becomes harmful when that injection causes damage, causes trespass.” The case is now positioned to test how courts balance the operational scale of major producers with the rights of neighboring operators.
